Understanding Summary Suit – Fast-Track Justice with Just Advo

A Summary Suit is a special legal procedure used for the speedy recovery of debts or liquidated amounts based on a written contract, invoice, or acknowledgment of debt. As per Order XXXVII of the Civil Procedure Code (CPC), 1908, this suit is filed when the defendant has no substantial defense, thereby saving time and unnecessary delays.

At Just Advo, we assist clients in filing Summary Suits for swift legal remedies, especially in cases involving dishonored cheques, unpaid invoices, or breach of financial agreements. This procedure limits the right of the defendant to defend the suit unless they get permission from the court by disclosing a valid and plausible defense.

Unlike regular suits, Summary Suits do not require a lengthy trial. Once the suit is filed, the court issues a summons directing the defendant to either pay the amount or seek leave to defend within 10 days. If the defendant fails to respond or their defense lacks merit, the court can pass a judgment in favor of the plaintiff immediately.
